On April 15, 2017, Theresa Gremillion, who had impaired cognition, fell from her wheelchair at Bayou Vista Community Care Center. The facility failed to conduct a physical assessment of her lumbar or hip area, despite clear policies requiring thorough evaluations for such incidents. The pain she experienced was wrongly attributed to her history of chronic back pain, leaving her injuries undiagnosed.
Weeks later, Ms. Gremillion developed a urinary tract infection (UTI) that the facility failed to monitor or properly treat. This negligence resulted in urosepsis, requiring her transfer to a hospital on June 5, 2017. During her hospitalization, doctors discovered a femoral neck fracture and supra pubic rami fractures that had gone untreated since the initial fall.
To prevent her from becoming bed-bound, Ms. Gremillion underwent hip replacement surgery. Tragically, post-operative complications led to her untimely death within a month.
The nursing home denied responsibility, claiming the fracture occurred during hospitalization, not the fall. However, through expert testimony, our attorneys demonstrated that the fractures were directly caused by the fall on April 15. They also successfully linked the uroseptic event and her deteriorated condition to the nursing home’s failure to assess and care for Ms. Gremillion properly.
After an extended litigation process, including pretrial motions, the case reached a $627,000 settlement—well above Louisiana’s $500,000 cap on medical malpractice claims.
